{"id":748,"date":"2024-08-13T20:11:39","date_gmt":"2024-08-13T11:11:39","guid":{"rendered":"https:\/\/www.japan-workers.com\/?p=748"},"modified":"2024-08-13T20:11:40","modified_gmt":"2024-08-13T11:11:40","slug":"difference-between-illegal-entry-and-illegal-landing2","status":"publish","type":"post","link":"https:\/\/www.japan-workers.com\/?p=748","title":{"rendered":"Difference between illegal entry and illegal landing(2)"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">I decided to add the definitions of &#8220;illegal overstaying&#8221; and &#8220;departure order&#8221; to this blog article &#8220;<a href=\"https:\/\/www.japan-workers.com\/?p=744\" target=\"_blank\" rel=\"noopener\" title=\"\">Difference between illegal entry and illegal landing<\/a>&#8221; that I posted on 9th of Aug, 2024.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once again, the definitions of &#8220;Illegal entry&#8221; ,&#8221;Illegal landing&#8221;, &#8220;Illegal overstaying&#8221;, &#8220;Order to leave&#8221;, &#8220;Deportation procedure&#8221;, &#8220;Departure order&#8221; in the Immigration Control Act are as followings;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Illegal entry, illegal landing, and illegal overstaying<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The definitions of the two words are as follows.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cases in which landing is refused as a result of the landing examination are neither illegal entry nor illegal landing. An \u201corder to leave\u201d will be issued and you will be sent back to your home country.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td>Illegal entry (\u4e0d\u6cd5\u5165\u56fd\uff1aFuhou Nyukoku)<\/td><td>Entering Japan\u2019s airspace and territorial waters without holding a passport or visa (*)<br>*Excluding visa-exempt countries<\/td><\/tr><tr><td>Illegal landing(\u4e0d\u6cd5\u4e0a\u9678\uff1aFuhou Joriku)<\/td><td>Entering land in Japan without going through landing inspection, regardless of whether you have a passport or visa.<\/td><\/tr><tr><td>Illegal overstaying(\u4e0d\u6cd5\u6b8b\u7559\uff1aFuhou overstaying)<\/td><td>Staying in Japan beyond the period of stay without renewing the period of stay or changing the status of residence.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">In this sense, the concept of \u201cthe order to leave as a result of illegal entry\u201d mentioned in the opening article does not hold true. The act of receiving the order to leave as a result of refusal of landing is not illegal act at all.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By the way, if you \u201cland\u201d without a passport or visa, you will be treated as \u201cillegal entry\u201d rather than \u201cillegal landing.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Order to leave and deportation (issuance of written orders)<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Similar terms are order to leave and deportation, but their meanings under the Immigration Control Act are as follows.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td>Word<\/td><td>Meaning<\/td><td>Landing refusal period<\/td><\/tr><tr><td>Order to leave (\u9000\u53bb\u547d\u4ee4\uff1aTaikyo Meirei)<\/td><td>This is only issued as a result of being refused landing as a result of \u201clanding examination\u201d.<\/td><td>N\/A<\/td><\/tr><tr><td>Deportation (\u9000\u53bb\u5f37\u5236\uff1aTaikyo Kyosei)<\/td><td>Broadly speaking, \u201cprocedures\u201d that apply when a foreigner who has landed or remains in Japan falls under deportation grounds (such as illegal landing or revocation of residence status).<br><br>In the procedure, the issuance of a deportation order constitutes the actual act of order.<\/td><td>5 years<\/td><\/tr><tr><td>Departure Order(\u51fa\u56fd\u547d\u4ee4\uff1aShukkoku Meirei)<\/td><td>A simple procedure for allowing people to leave the country without being detained in cases where they appear in court of their own will.<\/td><td>1 year<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Foreign nationals who leave Japan due to deportation procedures are not allowed to land in Japan for five years from the date of deportation (because undergoing deportation procedures itself is grounds for refusal of landing), but in the case of \u201corder to leave\u201d, there are no restrictions.
