The Question<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">To what extent should a system explain its decisions?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Explainability produces trust.<br>Yet full disclosure is neither realistic nor desirable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In immigration administration, certain forms of non-disclosure are unavoidable\u2014<br>due to national security, diplomatic considerations, and the prevention of system abuse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The question, therefore, is not simple.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>How much should be explained?<br>What must remain undisclosed?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is a problem of <strong>institutional boundary design<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">2. Redefining Explainability<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As defined in Chapter 8:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Trust is the condition in which individuals can understand, anticipate, and rely on institutional decisions.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From this follows the role of explainability:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Explainability is the ability to present the structure of a decision in a way that is understandable.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is not equivalent to transparency.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Explainability requires that individuals can grasp:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What factors were considered<\/li>\n\n\n\n<li>What perspectives were applied<\/li>\n\n\n\n<li>Why the decision was reached<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Understanding\u2014not full disclosure\u2014is the objective.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">3. Why Full Transparency Fails<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Complete transparency appears ideal,<br>but it can destabilize a system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are three primary risks:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Exposure of strategic vulnerabilities<\/strong><\/li>\n\n\n\n<li><strong>Gaming of the system through formal compliance<\/strong><\/li>\n\n\n\n<li><strong>Loss of adaptive discretion due to rigid rule-following<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">For this reason:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Full transparency does not necessarily produce trust.<br>It can undermine the system itself.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">4. Conditions for Legitimate Non-Disclosure<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Non-disclosure is not inherently justified.<br>It must meet specific conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this model, non-disclosure is acceptable only if:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>(1) It does not undermine explainability<\/strong><br>The logic of the decision must remain understandable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>(2) It does not conceal arbitrariness<\/strong><br>Non-disclosure must not function as a cover for irrational decisions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>(3) It preserves verifiability<\/strong><br>Internal review or third-party oversight must remain possible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In other words:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Non-disclosure is not an alternative to trust.<br>It is a controlled exception within a trust structure.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">5. The \u201cExplainable Black Box\u201d<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This boundary is operationalized through the concept of the:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u201cExplainable Black Box.\u201d<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not everything can be disclosed.<br>But nothing can be left entirely unexplained.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A system must ensure that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The existence of evaluation criteria is visible<\/li>\n\n\n\n<li>The direction of decision-making logic is indicated<\/li>\n\n\n\n<li>Case-specific reasoning is provided<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Through this approach:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Understanding can be achieved without full visibility.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">6. The Boundary of Discretion<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As discussed in Chapter 9, discretion is unavoidable.<br>The problem lies in its lack of structure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here, explainability plays a defining role:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Explainability establishes the boundary of legitimate discretion.<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Discretion that can be explained is structured<\/li>\n\n\n\n<li>Discretion that cannot be explained is indistinguishable from arbitrariness<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Explainability is the condition that allows discretion to exist without producing distrust.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">7. Institutional Implications<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This design aligns with key principles of administrative law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Review of the decision-making process<\/li>\n\n\n\n<li>Obligations to provide reasons<\/li>\n\n\n\n<li>The legitimacy of authority (presumption of validity)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These principles suggest that:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Authority becomes trustworthy only when its reasoning is accessible.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Without explanation, authority appears as imposition.<br>With explanation, it becomes a basis for reliance.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">8. Implications for Social Integration<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Immigration decisions are not merely procedural outcomes.<br>They shape individuals\u2019 lives, expectations, and sense of belonging.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When decisions are understandable,<br>individuals retain the capacity to accept outcomes\u2014<br>even unfavorable ones.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When decisions are not understandable,<br>distrust extends beyond the system to society itself.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Explainability is a precondition for social integration.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">9.
