The Question<\/h2>\n\n\n\n<p>How should discretion be handled in immigration systems?<\/p>\n\n\n\n<p>Discretion is often treated as a problem.<br>It is seen as a source of arbitrariness, inconsistency, and unfairness.<\/p>\n\n\n\n<p>But eliminating discretion entirely is neither realistic nor desirable.<br>Immigration decisions must account for complex, individual circumstances.<\/p>\n\n\n\n<p>The question, therefore, is not whether discretion should exist,<br>but <strong>how it can be structured so that it does not produce distrust<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">2. What Is Discretion?<\/h2>\n\n\n\n<p>In this model, discretion is defined as follows:<\/p>\n\n\n\n<p><strong>Discretion is the decision-making space within which an institution can interpret and apply rules beyond fixed criteria.<\/strong><\/p>\n\n\n\n<p>Discretion exists because rules are incomplete.<br>No system can anticipate every possible case.<\/p>\n\n\n\n<p>Therefore, discretion is not a failure of design.<br>It is a <strong>necessary feature of any functioning system<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">3.
