after entry into Japan, receiving insufficient support from their accepting organizations.<br>They lose their jobs, their living foundations become unstable, and they are left drifting at the margins of the system.<\/p>\n\n\n\n<p>But how does the system respond in such situations?<\/p>\n\n\n\n<p>In reality, these individuals are often assessed as having an \u201cunstable residence status\u201d when applying for an extension of stay or a change of status, which significantly raises the likelihood of denial.<\/p>\n\n\n\n<p>In other words, the party that should bear responsibility and the party that actually suffers disadvantage are reversed.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Where Responsibility Lies in the System<\/h2>\n\n\n\n<p>Under the Specified Skilled Worker system, legal responsibility under immigration law is clearly placed on the accepting organization.<\/p>\n\n\n\n<p>This includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Proper execution of employment contracts<\/li>\n\n\n\n<li>Securing appropriate remuneration<\/li>\n\n\n\n<li>Implementation of support plans<\/li>\n\n\n\n<li>Submission of required notifications<\/li>\n<\/ul>\n\n\n\n<p>All of these are obligations borne by the accepting organization\u2014not by the foreign worker.<\/p>\n\n\n\n<p>The obligations imposed on the foreign worker are limited: engaging in activities consistent with their status of residence and making certain notifications.<\/p>\n\n\n\n<p>In principle, the foreign worker is not the guarantor of the system, but rather its protected subject.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">The Reality of \u201cDrift\u201d<\/h2>\n\n\n\n<p>Nevertheless, even when accepting organizations fail to fulfill their responsibilities, such failures are not always promptly corrected.<\/p>\n\n\n\n<p>Support may not be provided, employment relationships may dissolve, and without a new workplace, the worker can no longer maintain the activities that form the basis of their residence status.<\/p>\n\n\n\n<p>At this point, the system focuses on the \u201cresidence situation\u201d of the individual and issues a denial based on its instability.<\/p>\n\n\n\n<p>What emerges is a clear structural distortion:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Original responsible party:<\/strong> Accepting organization<\/li>\n\n\n\n<li><strong>Actual bearer of disadvantage:<\/strong> Foreign worker<\/li>\n<\/ul>\n\n\n\n<p>Responsibility and risk are separated.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">The Problem of Asymmetric Assurance<\/h2>\n\n\n\n<p>This is not merely an operational issue.<br>It is a structural problem embedded in the system itself\u2014an <strong>asymmetry of assurance<\/strong>.<\/p>\n\n\n\n<p>Even if the accepting organization fails to fulfill its obligations,<br>the resulting instability in residence is treated as a problem of the foreign worker.<\/p>\n\n\n\n<p>As a result, the integrity of the system is, in effect, guaranteed by the most vulnerable party.<\/p>\n\n\n\n<p>From the perspective of the Balanced Coexistence Model, this is nothing less than a failure in the design of trust infrastructure.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Why Does This Structure Arise?<\/h2>\n\n\n\n<p>The reason is clear.<\/p>\n\n\n\n<p>While the system is strictly designed at the point of entry,<br>mechanisms for monitoring and correcting compliance after entry are insufficient.<\/p>\n\n\n\n<p>Violations by accepting organizations are not visualized in real time,<br>and foreign workers have limited means to correct them.<\/p>\n\n\n\n<p>Problems accumulate and eventually surface as \u201cinstability in residence status.\u201d<\/p>\n\n\n\n<p>By that stage, however, responsibility is no longer examined\u2014only the outcome is judged.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">The Question We Should Be Asking<\/h2>\n\n\n\n<p>It is important to reconsider how we frame the issue.<\/p>\n\n\n\n<p>Is the language ability sufficient?<br>Is the job content appropriate?<br>Is the residence status stable?<\/p>\n\n\n\n<p>These are important questions\u2014but they are not enough.<\/p>\n\n\n\n<p>What must be examined is the <strong>process<\/strong> through which that condition emerged:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Did the accepting organization fulfill its obligations?<\/li>\n\n\n\n<li>Was support actually provided?<\/li>\n\n\n\n<li>Could the system detect deviations at an early stage?<\/li>\n<\/ul>\n\n\n\n<p>Unless these questions are addressed,<br>the system will remain one that imposes outcome-based responsibility solely on individuals.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Toward Redesign as Trust Infrastructure<\/h2>\n\n\n\n<p>What the Balanced Coexistence Model calls for is bridging this gap between system and reality.<\/p>\n\n\n\n<p>What is needed is not simply stronger regulation.<\/p>\n\n\n\n<p>Rather:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Continuous visualization of the accepting organization\u2019s compliance<\/li>\n\n\n\n<li>Mechanisms for early correction when deviations occur<\/li>\n\n\n\n<li>A structure that allows institutional intervention before the foreign worker suffers disadvantage<\/li>\n<\/ul>\n\n\n\n<p>Those who bear responsibility must fulfill it,<br>and that fulfillment must be verifiable.<\/p>\n\n\n\n<p>That is the foundation of trust.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n\n\n<p>The Specified Skilled Worker system is not only a framework for accepting foreign labor;<br>it is also a system that supports the lives and futures of those individuals.<\/p>\n\n\n\n<p>If, within that system, the bearer of responsibility and the bearer of disadvantage do not coincide,<br>then the system must be considered incomplete.<\/p>\n\n\n\n<p>What is being questioned is not the suitability of the foreign worker,<br>but the suitability of the system
